1. Acceptance of Terms
By accessing and using Gaptech Solutions Ltd services, you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Services Provided
We provide fleet management solutions including:
- GPS vehicle tracking systems
- Fleet management software
- Speed governor installation
- Fuel monitoring systems
- Driver behavior analysis
- CCTV and dashcam solutions
3. User Obligations
You agree to:
- Provide accurate registration information
- Keep account credentials secure
- Use services legally and ethically
- Not tamper with or damage equipment
- Inform drivers about tracking devices
- Pay all fees on time
4. Payment Terms
4.1 Fees
- One-time installation fees
- Monthly subscription per vehicle
- Additional feature charges as applicable
4.2 Payment
Monthly fees are due on the 1st of each month. Late payments may incur a 5% penalty. Services may be suspended after 15 days of non-payment.
5. Equipment
GPS devices remain Gaptech property unless purchased. Clients must not remove, tamper with, or damage equipment. All equipment must be returned upon contract termination.
6. Service Availability
We aim for 99.5% uptime but cannot guarantee uninterrupted service. Temporary unavailability may occur due to maintenance, network issues, or force majeure.
7. Data and Privacy
We collect and process vehicle and location data as described in our Privacy Policy. We implement security measures to protect your data but cannot guarantee absolute security.
8. Limitations of Liability
Gaptech Solutions is not liable for:
- Indirect or consequential damages
- Loss of profits or data
- GPS accuracy issues due to external factors
- Third-party network failures
- Damages exceeding fees paid in the last 12 months
9. Warranties
Devices come with a 2-year warranty covering manufacturing defects. Services are provided "as is" without warranties of fitness for particular purposes.
10. Contract Duration
Minimum contract period is typically 12 months. Early termination may incur penalties. Either party may terminate with 30 days written notice after the minimum period.
11. Intellectual Property
All software, platforms, and materials are Gaptech property. You receive a limited license to use services. You may not copy, modify, or distribute our intellectual property.
12. Modifications
We reserve the right to modify these terms at any time. Changes will be posted on our website. Continued use after changes constitutes acceptance.
13. Governing Law
These terms are governed by the laws of Kenya. Disputes will be resolved in Kenyan courts.
